Property Owner Gets Legal Fees Covered Over Fight with Skunk Train

One more legal win for the man who stopped the Skunk Train from taking his land. A Mendocino County Judge has ruled that Mendocino Railway be responsible for John Meyer’s attorney fees after it had failed to acquire his 20-acre property by eminent domain. Meyer’s estimated attorney fees over three years are “in the neighborhood of $250,000.” It’s the latest in a slew of legal loses for Mendocino Railway during which it has argued unsuccessfully that they are a public utility, which would allow them to acquire land through eminent domain. They plan to appeal this decision and several others in local and federal courts. The Skunk Train is a popular tourist attraction, but has not been used as public transit or to transport lumber for decades.
