City of Santa Rosa Wants to Clarify New Law Regarding Police Records

City of Santa Rosa is declining to release certain police misconduct records officials contend may not need to be released under a new law.

Press Democrat reports that the Police Chief Hank Schreeder and Mayor Tom Schwedhelm would like the appeals court to decided whether state law mandating the release of certain police misconduct records applies to documents dated before the law took effect on January 1st. The two officials say they would be happy to comply if the courts order so but doing so prematurely may trigger legal action from Law Enforcement Unions. The new law, SB 1421, was signed by Governor Jerry Brown last September.
