Court Ruling Poised to Give SMART Train Money to Expand into Windsor

The SMART Train is scoring a legal victory. The California Supreme Court has cleared the way for SMART to use increased tolls from an escrow account paid for by Bay Area commuters on transportation project. This will allow SMART to get $40-million from the account to help extend the rail line to Windsor. The Howard Jarvis Tax Association’s lawsuit held up use of the funds arguing the toll increases from the Bay Area Toll Authority in 2019 constituted an illegally passed tax that should have required approval from two-thirds of voters. Two lower courts and the state supreme court now have disagreed. Provided other grants are successful, SMART anticipates the extension to Windsor to be completed by 2025 or 2026.
