A judge is denying a request for a gag order on Sonoma County District Attorney Carla Rodriguez. The gag order was requested by defense attorneys representing a man and woman charged in connection with the death of their 15-month-old daughter, who died from fentanyl poisoning. The order, requested in January, would have banned Rodriguez from publicly discussing the case. It follows news stories that reported inaccuracies in Rodriguez’s public service announcements about fentanyl. Prosecutors with the D.A.’s office argued that Rodriguez did not discuss the case and said a gag order would be an unconstitutional restriction on her free speech.
