Man Convicted in Sexual Assaults at Bay Area Festivals Denied New Sentencing

The sentence will stand for a Richmond man convicted in sexual assaults of attendees of BottleRock and Alameda County’s Spring Festival. Forty-seven-year-old Peterson William Fontes was convicted of two counts of sexual penetration by force, fear, or threats, plus charges of burglary and vandalism in December of 2019 and later sentenced to 16 years and eight months in prison. However, Fontes appealed for a new sentence under SB 567 which allows judges to impose an upper-term sentencing only when special aggravating factors are proven beyond a reasonable doubt or admitted by a defendant. However, Judge Scott Young rejected the appeal after Napa County District Attorney’s Office argued that the victims were particularly vulnerable and Fontes’ activity had been planned and involved “sophistication and professionalism.”
