Homeless Man Sues City of San Rafael Over Sanctioned Encampment

A homeless man is suing the city of San Rafael over health issues he claims were caused by living in an encampment by a highway. Forty-nine-year-old James Hellard says the San Rafael city-sanctioned homeless camp exposed him to highway noise and pollution. Since living under the overpass for the past two years, Hellard alleges the city put him at risk for illness and is responsible for his hearing loss. The lawsuit cites CDC data that suggests living near a major roadway can result in asthma, chronic obstructive pulmonary disease, and other negative health effects. A hearing on the suit is scheduled for April 22nd.
