
A Sonoma County judge has declined to imprison a man convicted of a 5th DUI. Over the objections of prosecutors, Judge Dana Simonds sentenced 60-year-old Juan Garnica Vigil to probation and also ordered him to enroll in a substance abuse treatment program. Vigil was on felony probation when he was arrested for DUI in Santa Rosa last June. His driver’s license was also suspended, and Vigil failed to install an ignition interlock device in his vehicle. Prosecutors were seeking the maximum of three years and eight months in prison.
