A California appellate court has upheld a city decision to declare a public property surplus.
The ruling allows Santa Rosa to move forward with plans to sell and redevelop Garage 5 on Third Street. Airport Business Center, a commercial landlord next to the garage, had challenged the decision, arguing it was arbitrary and lacked proper written findings.
The 1st District Court of Appeal found city officials conducted thorough studies showing sufficient downtown parking, costly repairs needed for the garage, and potential for better land use.
The decision also follows the Surplus Land Act, which requires local governments to prioritize housing when disposing of public property.
