A major rail-to-trail project is facing a legal challenge. According to a report from the Marin Independent Journal, SMART is being sued by over 60 property owners who claim the agency doesn’t have the right to build a public path across their land.
The lawsuit threatens a key segment of the Great Redwood Trail, which is planned to run from Marin to Humboldt counties. SMART officials say the trail is a vital part of their transit system, but the property owners disagree.
The legal battle is set for mediation in November.
